1. Preamble

These general terms and conditions of sale (hereinafter referred to as "Conditions") are concluded between Le Bonnet Français SARL, a company with a capital of 55,500 euros, registered at the RCS Bayonne under number 789 623 097 and TVA Intracommunautaire FR02789623097 and located at 28, chemin de Trouillet – 64100 Bayonne, hereinafter referred to as "Le Bonnet Français SARL", and secondly, any consumer or natural person wishing to make a purchase via the online sales site (Internet) www.lebonnetfrancais.fr, hereinafter referred to as the "Customer".

The website www.lebonnetfrancais.fr is hereinafter referred to as the "Site". All products sold by Le Bonnet Français SARL are listed on the company’s website, hereinafter referred to as the "Products".

On the Site of Le Bonnet Français SARL, Le Bonnet Français SARL allows the Customer to order online products from the brand Le Bonnet Français, according to these general conditions.

Any order placed with Le Bonnet Français therefore implies the unreserved acceptance by the Customer of these conditions. These general conditions may be modified at any time and without notice by Le Bonnet Français, the applicable conditions being those in force on the date of the order by the Customer.

2. Subject

These general conditions are intended to define the terms of sale between Le Bonnet Français SARL and its customers, from order to delivery, through the use of the services provided by Le Bonnet Français SARL and payment. They settle all the steps necessary for the placing of the order and ensure the follow-up of this order.

3. Products and Compliance

The products governed by these general conditions are those that appear on the website and which are accompanied by a description by Le Bonnet Français SARL. They are offered within the limits of available stocks.

The Products are described and presented with the greatest possible accuracy.

4. Customer’s obligations

The Customer declares to be at least 18 years old and to have legal capacity or to hold parental authorization allowing him to make an order on the Site.

The Customer undertakes to communicate to Le Bonnet Français SARL the real and necessary elements of information for the performance of the service subject to these conditions as requested online and according to his situation, in particular his name, Valid address, telephone and e-mail.

The Customer is responsible for the consequences resulting from false or inaccurate information transmitted or whose recovery would be unlawful.

The Customer can modify his data in the section «my account».

5. Order

Any order will be validated only after acceptance of payment.

Bonnet Français SARL reserves the right to cancel or refuse an order in case of dispute with the Customer on a previous order.

Le Bonnet Français SARL can accept orders within the limits of available stocks. It informs the Customer of the availability of the Products sold on the Site at the time of order confirmation.

If, despite the vigilance of Le Bonnet Français SARL , products are unavailable, Le Bonnet Français SARL will inform the Customer by e-mail as soon as possible.

The permanent or temporary unavailability shall not in any case engage the responsibility of Le Bonnet Français SARL, nor may it open any right to compensation or damages in favor of the Customer.

6. Price

The prices displayed on the Site are indicated in euros including all French taxes (French VAT and other taxes, if applicable), excluding delivery costs, participation in order processing costs and packing costs.

The shipping costs, participation in order processing and packing costs will be indicated in the Customer’s basket before final validation of the order.

Prices may be changed at any time without notice and in particular if tax or economic data change. The items will be invoiced on the basis of the rates in force at the time of registration of the order.

However, a price cannot be changed once the order of the user has been validated.

7. Delivery

Le Bonnet Français SARL delivers its products in metropolitan France and Corsica and can on request deliver to any country.

The delivery of products is made by the Colissimo service of the Post.

The products are shipped with the delivery note, to the delivery address indicated by the Customer during his order. Delivery cannot be made to hotels or post boxes. The delivery times indicated on the site are indicative, corresponding to average processing and delivery times. In order to respect these deadlines, the Customer must ensure that it has communicated accurate and complete information regarding the delivery address (such as: street number, building number, staircase, access codes, names and/or interphone numbers, etc.).

Bonnet Français SARL undertakes to inform the Customer of the evolution of the processing of his order.

In case of damaged packages (already opened, missing products...), the Customer undertakes to notify the carrier and Le Bonnet Français SARL, by all means, all reservations within 3 days after receipt of the product.

For the delivery of parcels in metropolitan France and Corsica, orders from Bonnets are processed and shipped within 48 hours maximum (except Saturday, Sunday and holidays).

For shipments in metropolitan France:

Delivery is made by the Colissimo service of La Poste. The time of delivery is indicative of 48H - 72H after shipment.

During the holiday season, between Christmas and New Year, our team is reduced and deliveries may be delayed during this period.

For international shipments:

Delivery is by default by the Colissimo International service of La Poste. The delivery time is indicative of 3 to 8 days after shipment.

If you have any problems or are experiencing an unreasonably long delay, please contact us.

An email is automatically sent to the customer at the time of shipment of products, provided that the email address indicated in the registration form does not contain any errors.

RETURN AND EXCHANGE

You have a choice:

• • Be reimbursed for the amount of returned products.

• • Exchange your item for a different colour or size

 

To do so, the Customer must first make a return or exchange request by e-mail to contact@leberetfrancais.com.

You have fourteen (14) days from the date of receipt of your order to inform us that you wish to return part or all of your order. If this period normally expires on a Saturday, Sunday or public holiday/day off, it is extended until the following working day.

 

The product must be returned within one week in its original packaging, in its original condition, new, unworn, unwashed, accompanied by the return slip, to the following address: LE BERET FRANÇAIS - 28 chemin de trouillet 64100 Bayonne.

 

If the Customer fails to comply with these conditions, in particular the return or exchange conditions, Le Bonnet Français SARL will not be able to refund the Products concerned.

Le Bonnet Français SARL undertakes to refund you within a maximum of 14 days from the day of receipt of your package in our warehouses. Refunds are made by credit on the bank card used to pay for the order.

8. Right of withdrawal

The right of withdrawal applies only to natural persons.

In accordance with article L121-20 of the consumer code, the customer has a right of withdrawal for fourteen calendar days from the date of receipt or withdrawal of the products. During this period, the customer may return the products to the factory without having to justify reasons or pay a penalty.

9. Payment

When a Customer is an individual, he or she can pay for his or her order online on the website of Le Bonnet Français SARL by credit card (blue card, e-card, Visa, Eurocard/Mastercard) or by using the services of the Paypal company available on the site. The Customer guarantees Le Bonnet Français that it has the necessary authorisations to use the payment method chosen by him. Le Bonnet Français SARL uses all the means necessary to ensure the security and confidentiality of data transmitted online (online payment on the website of the company Le Béret Français). For this purpose, the website of the company Le Bonnet Français uses a secure payment method SSL (Secure Socket Layer). In the case of a payment via Paypal, it is the company Paypal that has, only, the banking information provided on the site at the time of payment. The full payment must be made at the time of ordering. At no time can the amounts paid be considered as a deposit or down payment.

For all transactions by credit card, the Customer will indicate the number appearing on the front of his card, the expiration date of his card and the cryptogram appearing on the back of his card (last three digits). The communication by the Customer of his credit card number constitutes authorization for Le Bonnet Français to debit his account at a rate equal to the amount of his order.

If the customer chooses PayPal, the customer will be automatically directed to his PayPal account. In the case of out-of-stock or unavailable products, the amount of the products actually shipped will be debited.

The French Bonnet SARL retains ownership of the article until full payment of the price by the Customer. All information that customers communicate to Le Bonnet Français SARL is strictly protected and guarantees the compliance and security of each transaction. Warranties and Liability.

The French Bonnet SARL has, for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services, only an obligation of means. Le Bonnet Français SARL shall not be held liable for any inconvenience or damage inherent in the use of the internet, including a service disruption, an external intrusion or the presence of computer viruses, or any act of force majeure, in accordance with the law and case-law.

Bonnet Français SARL undertakes to use confidential information of the Clients only in connection with the operation of its Site.

For the proper processing of the order, the personal data collected will be processed by computer, the Customer acknowledges having knowledge.

As such, information concerning the user may be communicated to technical service providers of Le Bonnet Français SARL.

In addition, Le Bonnet Français SARL may use technical means to obtain non-personal information about users and improve the site’s functionality, for example by tracking the number of visitors on certain pages.

In accordance with the law of 6 January 1978, as amended by the law of 6 August 2004, the Customer has a right to access and correct personal data concerning him contained in the files of Le Bonnet Français SARL. 10. Intellectual property

Under no circumstances is the Customer authorized to download or modify all or part of the Site and in particular its content (listed products, descriptions, images...).

This Site or any part of this Site may not be reproduced, copied, sold or exploited for commercial purposes without the express written permission of Le Bonnet Français. In general, all copyrights, trademarks and other distinctive signs and property or intellectual property rights appearing on the Site remain the full and complete property of Le Bonnet Français SARL.

The Customer is therefore bound to respect intellectual property rights and may not use the trademarks appearing on the Site and on the Products, or file a trademark that would harm the owner of the rights, unless contractually agreed otherwise.

The same applies to any other intellectual property rights and photographs.11. Force majeure. In the event of an event of force majeure, the party concerned must inform the other within fifteen (15) days from the occurrence of this event, by registered letter with acknowledgement of receipt.

In addition to those usually considered by the jurisprudence of the French courts and tribunals, total or partial strikes are expressly considered as cases of force majeure or fortuitous events, lockout, riots, boycotts or other industrial actions or commercial disputes, civil unrest, insurrection, war, bad weather, epidemics, blocking of transport or supply for any reason, earthquake, fire, storm, flood, water damage, government or legal restrictions, legal or regulatory changes in forms of marketing, computer failure, blocking of telecommunications, including wired or terrestrial telecommunication networks, and any other case beyond the control of the parties that prevents the normal performance of the contractual relationship.
All obligations of the parties will be suspended for the duration of the force majeure event, without compensation.
If the force majeure event lasts for more than three (3) months, the contract concerned may be terminated by law without compensation to either of the parties.

11. General provisions. Applicable law – Competent court

These general conditions are subject to French law with regard to the substantive rules as well as the rules of form. Any dispute must be the subject of an attempt to amicable settlement.

In the absence of an amicable settlement, jurisdiction is assigned to the competent French courts, notwithstanding plurality of defendants or appeal as a guarantee. Reproduction of the applicable texts (order 2005-136 of 17 February 2005, Consumer Code, Civil Code)

Art. L. 211-4. of the Consumer Code

The seller is obliged to deliver a good in conformity with the contract and is liable for any defects of conformity existing at the time of delivery. He is also liable for defects of conformity resulting from the packaging, assembly instructions or installation when this has been placed on his account by the contract or was carried out under his responsibility.

Art. L. 211-5. of the Consumer Code

- To be in conformity with the contract, the property must:

1° Be fit for the usual intended use of a similar property and, if applicable:

- correspond to the description given by the seller and possess the qualities that he has presented to the Customer in the form of a sample or model;

- present the qualities that a Customer can legitimately expect in view of public statements made by the seller, the producer or its representative, particularly in advertising or labelling;

2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the Customer, brought to the knowledge of the seller and that he has accepted.

Art. L. 211-12. of the Consumer Code

The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

Art. 1641 of the Civil Code

The seller is liable for warranty in respect of hidden defects of the thing sold which make it unsuitable for the use to which it is intended, or which so diminish this use that the customer would not have acquired it, or would have given it only a lower price, if he had known them.

Art. 1648 paragraph 1 of the Civil Code

In the event of a dispute and after having contacted the professional’s customer service, any client has the possibility to contact a consumer mediator, within a maximum period of one year from the date of the written complaint by LRAR, with this professional.
